GetClawsterTerms of Service

1.Parties and Definitions
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Virix LTD, a company also operating under the trade name Virix Labs ("Company", "we", "us", or "our").
The following terms have specific meanings throughout this document:
- "Service" — the GetClawster platform, including the website at https://getclawster.cloud, the Telegram bot (@GetClawsterBot), Telegram Mini App (TMA), API endpoints, and all associated software and infrastructure operated by Virix LTD.
- "Agent" — your personal AI agent instance deployed by the Company on a dedicated server as part of your subscription.
- "Subscription" — a paid plan granting you access to the Service for a defined period (monthly, annual, or lifetime).
- "Content" — any data, text, files, instructions, or other material you submit to or through the Service.
- "User Data" — personal information associated with your account, as described in our Privacy Policy.
2.Eligibility
You must be at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
3.Account Registration and Security
3.1 Account Creation
Access to the Service is provided via your Telegram account through @GetClawsterBot. You are responsible for maintaining the security of your Telegram account and for all activities conducted through your Agent.
3.2 Bot Token
To deploy your Agent, you provide a Telegram bot token issued via BotFather. You are solely responsible for the security and proper issuance of your bot token. You must not provide a bot token belonging to a third party without their explicit authorization.
3.3 Account Responsibility
You are responsible for all actions taken by your Agent. Any violations of these Terms by your Agent — including actions taken autonomously — are attributable to you. You must promptly notify us at general@virixlabs.com if you suspect unauthorized access to your account.
4.Subscription Plans and Payments
4.1 Plans
We offer multiple Subscription tiers with varying features, resource limits, and durations. Current plan details, pricing, and features are described on our Website and within the Service. We reserve the right to modify pricing with at least 14 days' notice to existing subscribers.
4.2 Payment Methods
We accept payment via:
- Telegram Stars — Telegram's in-app currency, processed by Telegram
- Credit / debit card — processed by Stripe, Inc.
- Cryptocurrency (USDT TRC-20) — processed by 0xProcessing
All payments are processed by third-party payment processors subject to their own terms and conditions. Virix LTD does not store payment card data.
4.3 Billing Cycle
Monthly and annual subscriptions renew automatically unless cancelled before the renewal date. Lifetime plans are one-time purchases. You are responsible for cancelling your subscription before renewal if you do not wish to be charged.
4.4 Taxes
Prices listed are exclusive of taxes unless stated otherwise. You are responsible for all applicable taxes, duties, or levies imposed by your jurisdiction.
4.5 Refunds
Monthly/annual subscriptions: We offer a 3-day money-back guarantee from the date of first purchase. After 3 days, no refunds are issued for the current billing period.
Lifetime plans: No refunds after 7 days from purchase unless the Service is fundamentally non-functional and we are unable to resolve the issue within 72 hours of your written complaint.
Telegram Stars: Stars payments are subject to Telegram's own refund policies. We are unable to directly refund Stars; you must request a refund through Telegram.
Cryptocurrency: Due to the irreversible nature of blockchain transactions, cryptocurrency payments are non-refundable except at our sole discretion in cases of documented technical failure.
To request a refund, contact general@virixlabs.com with your Telegram user ID and transaction details.
5.Referral Program
Virix LTD operates an optional referral program ("Referral Program") whereby you may earn commissions by referring new paying Users to the Service.
- Commission rate: 30% of the net subscription revenue from each referred User for each period they remain a paying subscriber, as determined by Virix LTD in its sole discretion.
- Payout currency: Commissions are paid in USDT (TRC-20) to a wallet address you provide.
- Minimum payout: $5.00 USD equivalent. Balances below this threshold accumulate until the minimum is reached.
- Payout schedule: Manual, processed by Virix LTD on a rolling basis. Estimated processing time: up to 14 business days from request.
- Prohibited conduct: Self-referrals, fake accounts, cookie stuffing, misleading advertising, spam, or any fraudulent method of generating referrals is strictly prohibited and will result in immediate disqualification and forfeiture of all earned commissions.
- Modification: We reserve the right to modify or terminate the Referral Program at any time with 14 days' notice. Commissions earned prior to termination will be honored.
6.Permitted Use and Restrictions
6.1 Permitted Use
You may use the Service solely for lawful purposes and in accordance with these Terms.
6.2 Prohibited Conduct
You agree not to, and not to allow your Agent to:
- Violate any applicable local, national, or international law or regulation
- Generate, distribute, or facilitate spam, phishing, or any deceptive communications
- Scrape, harvest, or collect data in violation of a third party's terms of service
- Attempt unauthorized access to any system, network, or account
- Upload, transmit, or generate content that is illegal, defamatory, obscene, or violates any third party's intellectual property rights
- Use the Service to develop a competing product or service
- Reverse engineer, decompile, or attempt to extract source code from any component of the Service
- Resell, sublicense, or otherwise transfer access to the Service to third parties except through our official Referral Program
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Circumvent usage limits or access controls
- Use the Service to generate or disseminate CSAM, content that incites violence, or content designed to cause serious harm to individuals or groups
6.3 AI Usage Compliance
Your Agent is powered by third-party AI models (including but not limited to Anthropic's Claude, OpenAI's GPT, and OpenRouter-routed models). Your use of AI-generated content must comply with the acceptable use policies of the respective AI providers, in addition to these Terms.
7.Service Availability and SLA
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. Specifically:
- Target uptime: 99% measured monthly, excluding scheduled maintenance windows.
- Scheduled maintenance: We will endeavor to provide at least 24 hours' advance notice of planned downtime.
- No SLA credits: We do not currently offer service level credits for downtime. This may change in future plans.
- Third-party dependencies: The Service relies on third-party infrastructure (AI providers, proxy networks, Telegram). We are not liable for outages caused by these third parties.
We reserve the right to suspend, modify, or discontinue any aspect of the Service at any time. If we discontinue the Service entirely, we will provide at least 30 days' notice and offer pro-rated refunds for unused paid periods.
8.Intellectual Property
8.1 Our IP
The Service, including all software, design, branding, trademarks ("GetClawster", "Virix LTD", "Virix Labs"), and content created by Virix LTD, is the exclusive intellectual property of Virix LTD. Nothing in these Terms grants you any right, title, or interest in the Service except the limited right to use it as described herein.
8.2 Your Content
You retain ownership of all Content you submit to the Service. By submitting Content, you grant Virix LTD a non-exclusive, worldwide, royalty-free license to process, store, and use your Content solely to provide and improve the Service. We do not claim ownership of your Content or use it for training AI models without your explicit consent.
8.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by Virix LTD without restriction or compensation.
9.Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIRIX LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (D) ANY ERRORS WILL BE CORRECTED.
10.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIRIX LTD, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL
- COST OF SUBSTITUTE GOODS OR SERVICES
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY IS NOT PERMITTED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO VIRIX LTD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
11.Indemnification
You agree to defend, indemnify, and hold harmless Virix LTD and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Service or your Agent's actions
- Your violation of these Terms
- Your violation of any third party's rights (including intellectual property rights)
- Your Content
12.Termination
12.1 By You
You may terminate your account at any time by cancelling your subscription and ceasing use of the Service. Cancellation stops future charges but does not entitle you to refunds except as provided in Section 4.5.
12.2 By Us
We reserve the right to suspend or terminate your access to the Service immediately and without notice if:
- You breach these Terms in a material way
- Your use poses a security risk to the Service or other users
- We are required to do so by law
- You engage in fraudulent or illegal activity
For non-material breaches, we will provide written notice and a 7-day cure period before termination.
12.3 Effect of Termination
Upon termination: (a) your right to use the Service immediately ceases; (b) your Agent container will be stopped and scheduled for deletion within 30 days; (c) you may request an export of your data before deletion. Sections 8, 9, 10, 11, and 14 survive termination.
13.Modifications to Terms
We may revise these Terms at any time by posting an updated version on our Website. For material changes, we will provide at least 14 days' notice via the Telegram bot or email (if provided). Your continued use of the Service after the effective date of revised Terms constitutes your acceptance.
If you disagree with a material change, you may terminate your account and receive a pro-rated refund for the unused portion of your current subscription period.
14.Governing Law and Disputes
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts of the jurisdiction where Virix LTD is registered, as applicable.
Class action waiver: To the extent permitted by law, you agree to resolve disputes with Virix LTD on an individual basis only, and not as part of any class or representative action.
15.Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Virix LTD regarding the Service.
- Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable; all other provisions remain in effect.
- No waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely, including in connection with a merger or acquisition.
- Force majeure: Neither party is liable for delays or failures caused by circumstances beyond their reasonable control, including acts of God, government actions, internet failures, or third-party service outages.
- Language: The English version of these Terms is the authoritative version. Translations are provided for convenience only.
